Ho Chi Minh City's Task Force 1645 has recently agreed on a resolution approach for two residential projects facing legal complications. Initially, the force will consider issuing certificates for 68 eligible cases at the HQC Binh Trung Dong project. For the Screc II apartment complex, it was agreed to issue certificates to the buyers of all 120 sold units.
Task Force 1645, led by Mr. Nguyen Toan Thang, Director of the Ho Chi Minh City Department of Agriculture and Environment, recently held a working session with real estate enterprises to review and resolve obstacles related to the issuance of certificates to home buyers.
One of the cases focused on is the HQC Binh Trung Dong social housing project in Binh Trung Ward, with Hoang Quan Real Estate Consulting - Trading - Services Joint Stock Company as the investor.
Previously, the investor had requested the competent authorities to consider issuing land use rights and ownership certificates for assets attached to the land for the apartments in the project.
According to the Ho Chi Minh City Department of Construction, the project has a total of 225 apartments. During the process of completing procedures, the investor submitted 162 dossiers for the review of eligibility for purchasing or leasing social housing.
Upon review, the specialized authorities identified 68 dossiers that met the requirements. Meanwhile, the remaining 94 dossiers were required to be supplemented and completed by August 17.
Notably, 63 cases at the project have not yet submitted dossiers for the review of eligibility for purchasing or leasing social housing. The Department of Construction has sent notifications to each household, clearly stating the rights and obligations of social housing tenants and buyers, as well as the legal consequences of failing to perform the procedures as prescribed.
These cases are required to complete and submit their dossiers to the Ho Chi Minh City Department of Construction by August 25. After this deadline, if the investor and residents still fail to submit or supplement the dossiers as required, the incomplete cases will be determined as not meeting the conditions for leasing or purchasing social housing at the project.
At the meeting, Mr. Than The Hung, Deputy Director of the Ho Chi Minh City Land Registration Office, stated that HQC Binh Trung Dong is a project that has attracted public attention for a long time. The delay in resolving the certificate issuance procedures has caused frustration among residents.
According to Mr. Hung, the investor needs to urgently report and complete the dossiers so that the competent authorities have a basis to accurately determine the home buyers. Along with this, the enterprise needs to promptly establish the Apartment Management Board as prescribed.
Once the list of home buyers is fully determined, the land registration authority will have a basis to continue considering the issuance of certificates.
Concluding the working session, Mr. Nguyen Toan Thang agreed to initially consider issuing certificates for the 68 cases that the Department of Construction has determined to be eligible.
For the remaining cases, the Head of Task Force 1645 required the investor to fully implement the contents requested by the Department of Construction and cooperate with the competent authorities to determine any outstanding financial obligations.
After the necessary conditions are met, the Ho Chi Minh City Land Registration Office will continue to consider issuing certificates to home buyers.
The classification and handling of dossiers by group is seen as a resolution approach that ensures the rights of those who have fully completed the procedures while avoiding the issuance of certificates to cases that do not yet meet legal conditions.
Also at the working session, Task Force 1645 reviewed another case: the high-rise Screc II apartment complex, plot C46 in the An Phu - An Khanh Urban Area.
The project has 120 apartments, all of which have been sold by the investor to buyers. After reviewing issues related to the project's legality, Task Force 1645 agreed on a plan to issue certificates to home buyers.
Regarding the area under the investor's private ownership, the competent authorities agreed to retain it for the enterprise to fulfill outstanding obligations.
This handling method allows the rights of home buyers to be separated from the obligations that the investor has not yet completed, thereby creating a basis for resolving the certificate issuance procedures for apartments that meet the conditions.
Through the two cases reviewed, Task Force 1645 continues to focus on reviewing each project, each group of dossiers, and each legal obligation to propose appropriate handling methods. The goal is to resolve long-standing bottlenecks while ensuring that the issuance of certificates to home buyers is carried out on the basis of full legal compliance.
